1. Scope and provider

These terms govern the use of the KONFORMA software-as-a-service platform ("Service"), provided by Nowaity UG (haftungsbeschränkt), Feldmochinger Strasse 26, 80992 Munich, Germany ("we", "us"). They apply to every contract concluded between us and a customer ("you") for use of the Service, including any free plan. Conflicting or supplementary terms of the customer do not apply unless we expressly agree to them in writing.

2. The Service

KONFORMA helps manufacturers, importers and distributors of products with digital elements track and document their obligations under the EU Cyber Resilience Act (Regulation (EU) 2024/2847), including readiness scoring, software bill of materials (SBOM) handling, vulnerability monitoring, incident workflow support, and generation of draft documents such as declarations of conformity, CVD policies and regulatory notification drafts.

KONFORMA does not provide legal advice and does not perform a conformity assessment. Outputs generated by the Service (including declarations of conformity, technical documentation excerpts, and reporting drafts) are tools to support your own compliance process. Responsibility for legal compliance, for the accuracy of the underlying product data, and for the content and issuance of any regulatory document remains with you as manufacturer, importer or distributor at all times.

3. Registration and account

You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity under your account. Notify us without delay at contact@usekonforma.com if you suspect unauthorized use.

4. Plans, prices and payment

The Service is offered on a free plan and on paid subscription plans (currently Basic, Professional and Business) as described on our pricing page. Prices are shown in EUR, plus statutory VAT where applicable. Paid subscriptions are billed in advance, monthly or annually depending on the selected billing cycle, via our payment processor Stripe. Subscriptions renew automatically for the same period unless cancelled before the end of the current period.

We may change prices or plan features for future billing periods with at least 30 days' notice by email or in-app notice. If you do not agree to a price change, you may cancel your subscription effective at the end of the then-current period.

5. Term and termination

Free plan accounts run for an indefinite period and may be cancelled by either party at any time. Paid subscriptions run for the billing period selected at checkout and renew automatically; you may cancel at any time via the billing page in the app, effective at the end of the current billing period. The right of both parties to terminate for cause remains unaffected, in particular for material breach of these terms or non-payment.

On termination, we will make exported copies of your data (products, releases, SBOM records, reports) available for download for 30 days, after which we may delete the data in line with our Privacy Policy.

6. Availability and support

We aim for high availability of the Service but do not guarantee uninterrupted operation. Planned maintenance will be announced where reasonably possible. Support is provided by email at contact@usekonforma.com; response times may vary by plan.

7. Your data and content

You retain all rights to the product data, documents and other content you upload or create in the Service ("Customer Data"). You grant us the right to process Customer Data solely to provide and improve the Service. Personal data is processed as described in our Privacy Policy and, for processing on your behalf as controller, our Data Processing Agreement.

You are responsible for ensuring you have the right to upload the data you submit (including third-party software inventories) and that it does not infringe third-party rights or applicable law.

8. Intellectual property

The Service, its software, design and underlying documentation are protected by copyright and other intellectual property rights held by us or our licensors. We grant you a non-exclusive, non-transferable right to use the Service for the term of the contract, for your own business purposes.

9. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under mandatory statutory provisions (e.g. the German Product Liability Act). For ordinary negligence, we are liable only for the breach of a material contractual obligation (an obligation whose fulfilment is essential to the proper performance of the contract and on which you may reasonably rely), and in that case limited to the foreseeable, typical damage. Liability for indirect damage, lost profits, or for failure to achieve regulatory compliance is excluded to the extent permitted by law.

10. Changes to these terms

We may update these terms to reflect changes to the Service or legal requirements. We will notify you of material changes at least 30 days in advance by email or in-app notice. If you do not object within that period, the changes are deemed accepted; we will point this out in the notice. You may cancel instead of accepting a change.

11. Governing law and jurisdiction

These terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, the exclusive place of jurisdiction is Munich, Germany. Mandatory consumer-protection provisions of your place of residence remain unaffected where you act as a consumer.

12. Miscellaneous
